INTRODUCTION TO OUR AGREEMENT
Welcome to Boat Hire Dubrovnik. This document details the terms and conditions under which we offer our tours and events to you, the customer. Your engagement with us through accessing, browsing, and utilizing our services, including booking or ordering tours or events, signifies your informed consent to and acceptance of these terms and conditions.
1. Making Reservations and Bookings
Reservations for our tours and events can be made through various channels including our official website, email correspondence, telephone communication, or through third-party platforms that feature our offerings (such as hotels, travel agents, or other websites). The individual who completes the booking process is agreeing to these terms on behalf of all participants in the group and assumes responsibility for the fulfillment of all payment obligations. Please note that you must be at least 18 years of age to make a booking with us, ensuring that you have the legal capacity to enter into contractual agreements.
2. Detailed Payment Information
– Day Tours: For the reservation of our day tours, we require full payment at the time of booking to secure your spot.
3. Cancellation Policy Explained
To cancel a booking, we require written notice via email (antonio@boathiredubrovnik.com) . The timing of your cancellation notice determines applicable fees:
- More than 7 days before departure: No cancellation fee applies.
- Between 3 to 7 days before departure: Incurs a fee of 50% of the total cost.
- Less than 48 hours before departure: Incurs a fee of 100% of the total cost.
– No-show Policy: Failure to attend your booked tour without prior cancellation notice will result in a charge of 100% of the booking cost. This also includes failures to meet at the designated departure time.
– Adjustments by Us: While unlikely, we reserve the right to cancel or modify tours due to circumstances beyond our control. In such instances, we will communicate immediately with alternatives or offer a full refund if significant changes are made.
4. Responsibilities and Liabilities of Customers
As a participant, you have certain obligations to ensure the smooth operation of the tour:
– Understanding and Communication: It’s your responsibility to understand the terms of each activity and to communicate this information to all members of your group.
– Health and Fitness: You must ensure that your health and fitness levels are suitable for the activity booked. It’s crucial to inform the guide of any medical conditions or concerns that might affect your safety or the safety of the group during the activity.
– Following Safety Instructions: The safety of the group is paramount. Therefore, following the instructions of the guide or tour leader is obligatory for all participants.
5. Risk Acknowledgment
Our outdoor activities inherently carry certain risks. Despite our comprehensive safety management practices, it is impossible to eliminate all risks. By booking a tour with us, you recognize and accept the personal risk involved, understanding that these risks surpass those found in conventional holidays. We do not accept responsibility for accidents attributable to your own actions or those caused by external forces beyond human control, except in cases of clear negligence on our part.
6. Insurance Clarification
Please note that personal travel insurance and cancellation insurance are not included in the price of our tours and events. We strongly recommend obtaining comprehensive travel insurance that covers all the activities you plan to participate in.
7. Procedure for Complaints
Should you find any aspect of our service unsatisfactory, immediate verbal complaints should be made to us or the guide. For formal complaints, written notification must be sent to us within 15 days of the conclusion of your tour, allowing us to address and rectify the issue promptly.
8. Privacy and Personal Data
We are committed to protecting your privacy. This section outlines the types of personal information we collect, how it’s used, and under what circumstances it may be shared. We collect essential details like your name, contact information, and specifics of the services you’ve engaged with us for, solely to facilitate the provision of our services. Your information may be shared with necessary partners and third parties and our accountant, under strict confidentiality agreements.
9. Governing Law and Jurisdiction
These terms are governed by Croatian law. Disputes will be exclusively resolved in Croatian courts.
10. PRODUCTS OR SERVICES
Product price, payment method, and product shipment
The customer undertakes to pay for the ordered products by one of the following payment methods:
- By credit or debit card - payment directly via the Internet, using card payment services: MasterCard®, Maestro®, Visa by payment gateway SaferPay (view Security of Online Payments).
Suppose you have chosen to pay via Internet banking. In that case, we will send confirmation of your order to your e-mail address.
After receiving the payment, we will send you the ordered products. The ordered products are delivered to the customer under the delivery conditions.
The agreed purchase price includes all taxes and duties and is expressed in euros. Please note that the means of payment in the Republic of Croatia is the euro, and the customer pays the currency conversion cost.
Security of Online Payments
PS3-D Secure – 3DS for short – is supported by Visa (Visa Secure), Mastercard (Mastercard ID check), American Express (SafeKey), Diners Club (ProtectBuy) and others and is intended as an anti-fraud measure.
Via liability shift, merchants who offer the 3-D Secure process benefit from fewer payment defaults and from increased security with respect to credit card acceptance. It does not matter whether the card holder (CH) participates in this process or not.
The 3-D Secure procedure can only be used for payments on the Internet. If participating in the process, CHs must identify themselves to their card-issuing banks (issuer) while making payments. Payments that merchants conclude via 3-D Secure are to be specially flagged. Only when the corresponding criteria have been sent with the authorisation to the credit card company does the liability shift apply. This step is done automatically via the Transaction Interface and the Payment Page, meaning that no additional integration costs arise. The authentication of the CH proceeds via a web form provided by the issuer or by the service provider contracted by the issuer. The 3-D Secure authentication of the CH is done via an Internet browser.

REFUND POLICY
We have a 15-day return policy, which means you have 15 days after receiving your ticket to request a return.
We offer a refund of 50% of the booking fee in the event of cancellation, as the reservation entails a commitment of space. This refund will be processed within 15 days of cancellation. Please note that the refund will be credited back to the original payment method used for the reservation.
